Privacy Policy

PRIVACY POLICY

Version effective from August 21, 2026. Replaces the version of December 1, 2025.

1. INTRODUCTION

This Privacy Policy explains how Giga Techspace Inc. (“Company”, “we”, “us”) collects, uses, and protects your personal information.

It covers two things, and says which is which throughout:

The Website — our public marketing site at gigatechspace.com. You can read it without an account. We measure how it is used and we reply to enquiries sent from it.

The Platform — the Giga Techspace application at app.gigatechspace.com, which you use with an account, under the Terms and Conditions applicable to you as a Client or as a Specialist.

Operational Structure:
Giga Techspace Inc. is the operator of the Platform and the Controller of your data. The Platform is technically maintained and developed by our parent company and technology partner, Giga Techspace Sp. z o.o. (based in Poland), acting as a service provider.

Location of Data:
All personal information is stored on secure servers located in the United States. While our technology team in Poland may access the infrastructure for maintenance and development purposes, the primary storage and control of data remain in the U.S. under U.S. law.

3. PERSONAL INFORMATION WE COLLECT

A. On the Website. The Website has no account, no login and no file upload. Information reaches us in three ways:

— Usage data: pages viewed, referring source, approximate location derived from IP address, device and browser type, and interactions such as which call to action was selected. Collected through cookies, as described in section 4.

— What you send us: if you email us, or use a page that opens a pre-filled message, we receive whatever you choose to write and your email address. The project planning and estimating tools on the Website run entirely in your browser; the answers you select are not transmitted to us unless you send them yourself.

— Server logs: standard request data, including IP address and timestamp, recorded to serve the site and identify abuse.

B. On the Platform. We collect information necessary to operate our B2B platform:

— Identity & Contact Data: Name, email, phone, business address.

— Professional Data: Skills, portfolio, employment history (for Specialists).

— Project Data: Project specifications, deliverables, files.

— Financial Data: Payment details (processed by secure third-party providers).

— Technical Data: IP address, device logs, Workspace usage metrics.

4. COOKIES, ANALYTICS AND ADVERTISING

We use Google Analytics 4, provided by Google LLC, to understand how the Website is used and which content leads to enquiries. It sets cookies that generate a pseudonymous identifier for your device. Our Analytics property is linked to Google Ads accounts we control, which lets us measure which campaigns produce enquiries and build audiences for advertising; advertising cookies may therefore be set and data may be shared with Google for that purpose.

Cookies are set only in line with the choice you make in our cookie banner. Categories, names and durations are described in our Cookie Policy, and you can change your choice at any time from the banner or from the Cookie Settings control on the Website.

Visitors from the European Economic Area, the United Kingdom and Switzerland start with analytics and advertising storage denied by default under Google Consent Mode, and nothing is written until you say otherwise.

You can also block collection at any time using the Google Analytics opt-out add-on, by blocking cookies in your browser, or by enabling your browser’s Global Privacy Control signal, which we honour as an opt-out.

5. HOW WE USE YOUR INFORMATION

We use your data to:

— Operate and secure the Website, and answer enquiries you send us.

— Understand which Website content is useful, and measure the campaigns that lead to enquiries.

— Provide the Platform services and manage the marketplace.

— Provide access to specialized software (e.g., Autodesk licenses held by us).

— Verify identity (KYB/KYC) and prevent fraud.

— Maintain and develop the Platform software (supported by our tech team in Poland).

— Train and refine our AI tools (strictly in accordance with our Terms).

We do not use Website data for automated decision-making that produces legal or similarly significant effects.

6. DATA SHARING AND SERVICE PROVIDERS

To operate the Website and the Platform, we share data with trusted service providers:

A. Technology & Maintenance Provider:
We share data with Giga Techspace Sp. z o.o. (Poland), our parent company, solely for the purposes of software development, platform maintenance, debugging, and technical support. They act as a processor/service provider under our instruction.

B. Infrastructure & Tools:

— Cloud Hosting: Servers located in the USA (e.g., AWS/Azure).

— Payment Processors: Secure payments (e.g., Stripe).

— AI Services: OpenAI and verification tools.

— Website analytics and advertising measurement: Google LLC, as described in section 4.

C. No Sale of Data:
We do not sell your personal information for money. Under U.S. state privacy laws, the Google Ads link described in section 4 may count as “sharing” personal information for cross-context behavioural advertising; section 8 explains how to opt out.

We also disclose data where the law requires it, or to establish or defend legal claims.

7. DATA RETENTION

We retain data only as long as necessary for business purposes or as required by U.S. tax and legal regulations (typically up to 7 years for financial records).

Website analytics data is retained for up to 14 months and is then deleted or aggregated. Server logs are retained for up to 90 days. Email correspondence is kept for as long as the business relationship is active and afterwards for the period in which contractual claims may still be raised.

8. YOUR RIGHTS (U.S. USERS)

Texas Residents (TDPSA): You have the right to access, correct, delete, and obtain a copy of your data, and to opt-out of targeted advertising.

California Residents (CCPA/CPRA): You have the right to know, delete and correct your personal information, and to opt out of its sale or sharing. To opt out of sharing for advertising, use the cookie banner, the browser controls described in section 4, or email us. We honour the Global Privacy Control signal as an opt-out, and you will not be treated differently for exercising any right.

Other U.S. Residents: We provide similar rights to access, correction, and deletion.

Children (COPPA): Our Platform is for professionals. We do not knowingly collect data from children under 13.

9. ADDITIONAL NOTICE FOR EU/EEA USERS ONLY (GDPR NOTICE)

This section applies SOLELY to users located in the European Economic Area (EEA).

A. International Transfer to the U.S.
By using our Platform, you transfer your personal data to Giga Techspace Inc. in the United States.

— Legal Basis for Transfer: We rely on Standard Contractual Clauses (SCCs) and/or the necessity of performance of a contract (Art. 49(1)(b) GDPR).

B. Legal bases for Website processing. Operating and securing the Website rests on our legitimate interest in running it. Answering your enquiry is necessary to take steps at your request before entering a contract. Analytics and advertising cookies rest on your consent, given through the cookie banner and withdrawable at any time.

C. Role of Giga Techspace Sp. z o.o.
For EU users, Giga Techspace Sp. z o.o. acts in two capacities:

— Processor: Providing technical maintenance of the Platform.

— EU Representative (Art. 27 GDPR): Acting as a point of contact for GDPR compliance.

E. Your GDPR Rights
EU users have the right to access, rectify, erase, restrict processing, object, and data portability. You can lodge a complaint with a supervisory authority (e.g., UODO in Poland).

10. UPDATES AND CONTACT

We may update this policy. Continued use of the Website or the Platform constitutes acceptance. Material changes are announced on the Website before they take effect.
